These Terms of Use (“Terms”) govern access to and use of the Eunovya mobile application, eunovya.com and related services.

2. Eligibility
Eunovya is intended for users aged 18 or over. Users must have the legal capacity required to accept these Terms and use the service.
3. Account Creation and Security
Some features require an account. Users agree to provide accurate information and keep it up to date.
Users are responsible for keeping their credentials confidential and should promptly report any unauthorized use of their account.
Accounts may be created using email and password or through a supported authentication provider such as Google or Apple where available.
4. Acceptance of the Terms and Privacy Information
Creating an account requires acceptance of these Terms. The Privacy Policy is provided separately to explain how personal data is processed.
Where Eunovya processes health-related data on the basis of consent, separate explicit consent is requested. Acceptance of these Terms does not constitute consent to the processing of health-related data.
5. Service Description
Eunovya provides information and tracking features relating to nutrition, meals, weight, personal goals and physical activity. Certain features use automated processing or artificial intelligence to produce estimates, scores, summaries or recommendations.
6. Acceptable Use
Users must use Eunovya lawfully and in accordance with these Terms.
In particular, users must not:
- attempt unauthorized access to the service or another user's account;
- bypass security, usage limits or subscription controls;
- use abusive automation or interfere with service operation;
- submit unlawful content or content infringing third-party rights;
- use fraudulent payment or subscription methods.
7. User-Submitted Content
Users remain responsible for information, text and photographs they submit and warrant that they have the rights necessary to use them through the service.
Users grant Eunovya only the rights technically necessary to provide the requested features, including temporary storage, analysis and display of that content within their own account.
8. Nutrition, Activity and Medical Disclaimer
Information, calorie and nutrient values, scores, calculations, goals, estimates and recommendations provided by Eunovya are informational and may be approximate or inaccurate, particularly where generated from a photograph, free-text description or automated processing.
Eunovya does not provide medical diagnosis, prescription, treatment or medical advice. The service is not a substitute for a physician, dietitian or other qualified healthcare professional.
Users with a medical condition, prescribed diet, eating disorder, pregnancy, other specific medical circumstances, or concerns regarding nutrition or physical activity should consult an appropriate healthcare professional.
9. Third-Party Services
Certain features may depend on third-party services including Google, Apple, Health Connect, OpenAI, Firebase or application stores. Availability and operation may depend on those providers and on permissions granted by the user.
10. Premium Subscriptions and In-App Purchases
Eunovya may offer Premium features through subscriptions. Available plans, prices, durations and any promotional periods are displayed before purchase in the application and/or the applicable store.
Payments are handled by Google Play on Android and by Apple through the App Store where iOS purchases are offered. Eunovya does not directly collect the complete payment-card number used with those platforms.
Unless otherwise stated by the store or offer, subscriptions may renew automatically. Users can manage or cancel subscriptions through their Google Play or App Store account settings, subject to the applicable platform rules.
Refund, billing and mandatory consumer rights apply in accordance with applicable law and the terms of the payment platform concerned.
11. Availability, Maintenance and Changes
Eunovya may be temporarily unavailable because of maintenance, updates, technical incidents, force majeure events or events involving third-party providers.
Eunovya may evolve the service and add, modify or remove features subject to applicable legal requirements and user rights.
12. Intellectual Property
Eunovya's brand, name, interfaces, graphics, texts, software, databases and original content are protected by applicable intellectual-property laws.
Users receive only a personal, non-exclusive, non-transferable and revocable right to use the service in accordance with these Terms.
13. Account Suspension and Deletion
Users may delete their account using the feature provided in the application.
Eunovya may suspend or close an account in the event of fraudulent, unlawful or abusive use, conduct affecting service security or a material breach of these Terms, subject to applicable law.
14. Liability
Eunovya uses reasonable efforts to provide a reliable service but does not guarantee uninterrupted availability or the absolute accuracy of estimates, automated analyses or third-party data.
Users remain responsible for decisions they make based on information supplied by the service. Nothing in these Terms excludes or limits liability where doing so is prohibited by mandatory law.
15. Personal Data
Personal-data processing is described in the Privacy Policy.
16. Changes to these Terms
Eunovya may update these Terms to reflect changes to the service or applicable law. The version number and update date are shown at the top of this document.
Where a material change requires renewed acceptance, users may be asked to accept the new version before continuing to use the relevant features.
17. Governing Law
These Terms are governed by French law, without prejudice to any mandatory more protective consumer law that may apply in the user's country of residence.
